1 Scope

These Terms and Conditions (“Terms”) apply to all services offered by Raffael Frenner, trading as timebyraf (“I”, “me”, or “timebyraf”), via timebyraf.com. By booking a service or reaching out for a project, you agree to these Terms. I’m happy to answer any questions before we get started — just drop me a message.

2 Services

I offer a range of creative and advisory services, including but not limited to:

• Photography – professional photography for watches, events, hotels, real estate, products, and editorial content
• Social Media Content Creation – photo and visual content tailored for Instagram, LinkedIn, and other platforms
• Social Media Consulting – strategic advice on content, positioning, and visual identity
• Watch Consulting – personalised guidance for buying, selling, or researching timepieces

Each project is individually scoped and agreed upon before work begins.

3 Booking & Agreement

A binding agreement is established when:

• you submit a booking or project inquiry, and
• I confirm the project in writing (e-mail is sufficient).

The specific deliverables, timeline, and pricing will be outlined in the individual project agreement or invoice. I’ll always make sure we’re aligned before anything starts.

4 Pricing & Payment

Prices are stated in the individual offer or invoice and are exclusive of VAT where applicable under Italian law.

Payment is due in full in advance. Work begins after full payment has been received. Payment details are included in the invoice. If payment is not received within the agreed timeframe, I reserve the right to postpone the project start until payment is confirmed.

5 Cancellations & Refunds

Life happens — here’s how I handle cancellations:

• Cancellations must be submitted in writing (e-mail is fine).
• If you cancel more than 7 days before the agreed project date or start, you’ll receive a full refund.
• If you cancel within 7 days, no refund can be issued, as time and preparation will have already been committed.
• If I need to cancel for any reason, you will receive a full refund without delay.

6 Intellectual Property & Usage Rights

All photographs, videos, and creative content produced by Raffael Frenner remain my intellectual property unless a full transfer of rights is explicitly agreed upon in writing.

Upon receipt of full payment, you receive a non-exclusive, non-transferable license to use the delivered content for the purpose agreed upon (e.g. personal use, social media, commercial use, hotel marketing, real estate listings).

• Resale or sublicensing to third parties requires prior written consent.
• A credit (“© timebyraf” or “Photo: Raffael Frenner”) is always appreciated and may be required depending on the agreed usage scope.

7 Watch Consulting – Advisory Disclaimer

Watch consulting is provided as personal, experience-based advice and is for informational purposes only. While I bring genuine expertise and care to every consultation:

• I do not guarantee specific outcomes of any purchase, sale, or investment.
• I am not liable for financial loss resulting from decisions made based on my advice.
• All final decisions remain solely with you as the client.

8 Limitation of Liability

To the extent permitted by Italian and EU law, my liability is limited to the amount paid for the specific service in question. I am not liable for indirect or consequential damages, including loss of revenue or data, arising from the use of my services or website.

9 Privacy & Data Protection

Your personal data is processed in accordance with the EU General Data Protection Regulation (GDPR) and Italian law (D.Lgs. 196/2003 as amended). Please refer to the separate Privacy Policy on this website for full details on how your data is handled, stored, and protected.

10 Governing Law & Jurisdiction

These Terms are governed by the laws of Italy. Any disputes shall fall under the exclusive jurisdiction of the Court of Bolzano (Tribunale di Bolzano), Italy.

For clients based in other EU countries, applicable mandatory consumer protection laws of your country of residence remain unaffected.

11 Changes to These Terms

I may update these Terms from time to time. The latest version will always be available on this website with the date of last revision. Continued use of my services after an update means you accept the revised Terms.
